Announcement of the High Judiciary Council (HJC) of Saudi Arabia regarding the beginning of Dhul-Hijjah.

1 Dhul-Hijjah will be tomorrow, Friday 28 October 2011, and the Muslims performing Hajj will be in ‘Arafah on Saturday 5 November 2011 (9 Dhul-Hijjah 1432), and the Muslim Ummah shall be celebrating ‘Eed al-Adhaa on Sunday 6 November 2011, (10 Dhul-Hijjah 1432), inshaa.-Allaah.

In the name of Allaah, The All-Wise, The All-Knower, and may peace and blessings be upon the noblest of Prophets and Messengers, our Prophet Muhammad, his family and companions, as for what follows;

Advice concerning the Ten days of Dhul-Hijjah by Sheikh Muhammad ibn Saalih al-’Uthaymeen, may Allaah have mercy upon him.

Question:

Oh noble sheikh, in a few days we wll be entering into the ten days of Dhul-Hijjah. So what is your advice for the people regarding taking advantage of them? I hope for an explanation of its’ virtues and the actions that should be performed in it.

Answer: The ten days of Dhul-Hijjah begins wth the entrance of the month and ends on the day of the ‘eid. The Messneger, may peace and blessings be upon him, said about actions in these ten days:

“There are no days wherein righteous actions are more beloved to Allaah than these ten days.” They said: Not even jihad in the way of Allaah? He said: “Not even jihad in the way of Allaah, except for a man who leaves out (for jihad) with his wealth and self and doesn’t return back with any of them.”[Ibn 'Abbaas-Saheeh Bukhaaree]

So with this I strongly encourage my muslim brothers to sieze this tremendous oppurtunity, to perform many righteous actions in these ten days from recitation of the Qur’aan, rememberance of Allaah, charity, fasting, etc, strive to perform many different acts of obedience.

Its’ very troubling to see that the people are heedless about these ten days. Do you not find them exerting themselves in the last ten nights of Ramadan? Na’m of course they exert themselves in them. However with the ten days of Dhul-Hijjah you will be hard pressed to find one who differentiates between them and other than them. But if a person performs righteous actions in these ten days he revives that which the Messneger, peace and blessings be upon him, instructed with doing.

Also if an individual intends to slaughter at the ending of these ten days then he shouldn’t remove anything from his hair, nails, or body.

As for someone slaughtering on his behalf, then there’s nothing wrong with him clipping his own nails or cutting his hair. And if a person wants to slaughter for himself and his household with one sacrifice as is the sunnah, then it isn’t upon his family to abide by this principle. It only pertains to the one slaughtering, in this instance that being the father…

السلام عليكم ورحمة الله وبركاته

أيها المسلمون : الأضحية سنة مؤكدة في حق من يستطيعها تذبح في البيوت ويأكلون منها في بيوتهم ويهدون منها لجيرانهم ،ويتصدقون منها على من حولهم من الفقراء .
واما ما أحدثه بعض الناس من دفع ثمن الأضحية للجمعيات الخيرية لتذبح خارج البلد وبعيداً عن بيت المضحي ،فهذا خلاف السنة وهو تغيير للعبادة،فالواجب ترك هذا التصرف وأن تذبح الأضاحي في البيوت وفي بلد المضحي ،كما دلت عليه السنة ،وكما عليه عمل المسلمين من عهد رسول الله صلى الله عليه وسلم حتى حصل هذا الإحداث فإني أخشى أن يكون بدعة،وقد قال النبي صلى الله عليه وسلم “من أحدث في أمرنا هذا ما ليس منه فهو رد”،وقال عليه الصلاة والسلام :”وإياكم ومحدثات الأمور ،فإن كل محدثة بدعة، وكل بدعة ضلالة”.
ومن أراد أن يتصدق على المحتاجين فباب الصدقة مفتوح ،ولا تغير العبادة عن وجهها الشرعي باسم الصدقة – أعوذ بالله من الشيطان الرجيم:((وما آتاكم الرسول فخذوه وما نهاكم عنه فانتهوا واتقوا الله إن الله شديد العقاب))

Shaykh Fawzan:
O Muslims! Udh-hiyah is a stressed Sunnah for the one who is able to do it. It is slaughtered in the houses, they eat from it in their houses, give some of it to their neighbors, and give some of it as charity to those poor people around them.

As for what some of the people have invented, from paying the price of the udh-hiyah to charity organizations who slaughter (for them) outside of their city and far away from the house of the one offering the udh-hiyah, then this is against the Sunnah and changing an act of worship. So it is obligatory to leave this transaction and slaughter the udh-hiyahs in the houses and in the same city as the one offering the udh-hiyah, as is shown in the Sunnah and as has been the practice of the Muslims since the time of the Messenger of Allaah (sallallaahu ‘alayhe wa sallam) up until this invention has occurred. And I am afraid that it may be an innovation, and the Prophet (sallallaahu ‘alayhe wa sallam) had said, “Whoever introduces into our affair something that is not part of it, it is rejected.” And he (sallallaahu ‘alayhe wa sallam) said, “Be warned of newly invented matters, for verily every newly invented matter is an innovation, and every innovation is a straying.”

So whoever wants to give in charity to those in need, then the door of charity is wide open, but do not bring change to the correct Shar’ee way of an act of worship by calling it a sadaqah, I seek refuge in Allaah from the accursed Shaytaan, (( And what the Messenger gives you, then take it, and what he forbids you from, then cease doing it, and fear Allaah, verily Allaah is severe in punishment. )) [al-Hashr:7] May Allaah bless me and you by way of the great Qur’aan.

Shaykh Uthaymeen:

“…the sacrifice is a clearly defined worship, because if the intent behind the sacrifice was to benefit the people with the meat then the people would have bought meat and gave it away as charity on the day of the Eid. Rather, the most important thing is the sacrifice for Allaah the Mighty and Majestic, as Allaah the Exalted said,

‘It is neither their meat nor their blood that reaches Allaah, but it is piety from you that reaches Him.’ (Sura Hajj verse 37) Then also, if you sent out money to another town for the sacrifice to be done for you then you have opposed the command of Allaah, because Allaah the Exalted said,

‘Then eat thereof and feed therewith the poor who have a very hard time.’ (Sura Hajj verse 28)

And so is it possible for you to eat from it when it was sacrificed in Somalia?…No! Then you have opposed the command of Allaah. And many of the Scholars have said, ‘Eating from the sacrifice is obligatory and the person will be sinning if he leaves it off’. And by this we know that the call to implore that money for the sacrifice is sent outside of the person’s town is a call that is not correct. And that it is not befitting for the people to partake in this, rather sacrifice at your houses and with your families and manifest the rites of Islaam in your town.

And whoever wants to benefit their brothers in the places where they are in need, then benefit them with money and with clothes and other than that. But as for a rite from the rites of Islam that we use to draw near to Allaah by sacrificing and eating from it, then it is never befitting for the people to forsake this.”

Giving a part of Ud-hiyah/Aqeeqah meat to non-Muslim neighbors

Q 1: If a neighbor is a Kafir (non-Muslim), but he never disturbs me with regard to ‘Ibadah (worship); is it permissible to give him from the Ud-hiyah (sacrificial animal offered by non-pilgrims) and from the ‘Aqiqah (sacrifice for a newborn)? Respected Shaykh, we hope you will clarify this issue for us.

A: It is permissible to give a Kafir from the meat of an Ud-hiyah or ‘Aqiqah, as a way of showing kindness to the neighbor and fulfilling our Islamic duty as neighbors.

May Allah grant us success! May peace and blessings be upon our Prophet, his family and Companions!

Q: I am married, praise be to Allah, and I have children. I live in a city other than the city in which my family lives, but on holidays I go to the city where my family is. On ‘Eid-ul-Adha (the Festival of the Sacrifice), my children and I came five days before the ‘Eid but we did not offer the Ud-hiyah (sacrificial animal offered by non-pilgrims) even though I am able to, praise be to Allah.

Is it permissible for me to offer Ud-hiyah? Is my father’s Ud-hiyah valid on behalf of myself and my wife and children? What is the ruling on Ud-hiyah for the one who is financially able? Is it obligatory on the one who is not able? Is it permissible to take a loan in order to offer the Ud-hiyah? A.A.Sh. Rafha’ the Kingdom of Saudi Arabia.

A: The Ud-hiyah is a Sunnah (supererogatory act of worship following the example of the Prophet), not Wajib (obligatory), and one sheep is sufficient on behalf of a man and the members of his household, because the Prophet (peace be upon him) used to sacrifice two-horned rams that were white speckled with black, every year; one on behalf of himself and the members of his household, and the other on behalf of those among his Ummah (nation based on one creed) who believe in the Oneness of Allah.

If you, dear questioner, are living in a separate house, then the Ud-hiyah offered by your father on behalf of himself and the members of his household is not sufficient for you, because you are not living with them in the same house. It is prescribed for you to offer Ud-hiyah on behalf of yourself and your family. There is nothing wrong with a Muslim taking a loan to offer Ud-hiyah if he is able to repay it. May Allah grant us all success

Fasting on The Day of Arafah

As-Salāmu ‘Alaykum,

Bismillāh:

On the authority of Abū Qatādah al-Anṣārī (1):

…The Messenger of Allāh, prayers and peace upon him, was asked about fasting on The Day of ‘Arafah. [He, prayers and peace upon him, replied]: ‘Fasting on the day of ‘Arafah is an expiation of last year’s and next year’s sins.’ [Collected by Muslim/#1162]

[Issues Pertaining to this Prophetic Tradition]

[1]: What is ‘Arafah?

Shaykh al-‘Uthaymīn [d. 1421 AH], may Allāh have mercy on him, said:

Arafah is a well-known place related to the rites of Ḥajj, and standing at ‘Arafah is a pillar of Hajj [i.e. it is something that the pilgrim must do]…The Messenger of Allāh said: ‘Hajj is ‘Arafah.’ (2)/(3)

[2]: What is The Day of ‘Arafah?

He (Shaykh al-‘Uthaymīn), may Allāh have mercy on him, also said:

The Day of ‘Arafah is the ninth of Thūl Ḥijjah according to the Islamic calendar. It has been named The Day of ‘Arafah because it is the day when all pilgrims stand at ‘Arafah. (4)

[3]: Benefits from This Prophetic Tradition:

Shaykh al-‘Uthaymīn [d. 1421 AH], may Allāh have mercy on him, said (summarized): Some benefits of this Prophetic practice are what follows:

1. The diligence of the Companions in seeking beneficial knowledge

2. The rewards for performing an action are of two types:

a.) [you will] be given something desirable; or

b.) [you will] have something undesirable removed.

The reward for fasting The Day of ‘Arafah is of the second type (i.e. having something undesirable removed) due to the statement of the Messenger of Allāh: ‘Fasting the day of ‘Arafah is an expiation of last year’s sins.’

3. It is possible for past, as well as future sins to be expiated… (5)

[4]: The Fiqh Ruling on Fasting on the day of ‘Arafah:

In the Ḥanbalī fiqh book Zād al-Mustaqnī, Imām al-Ḥajjāwi [d. 968 AH], may Allāh have mercy him, wrote: “And fasting the day of ‘Arafah is recommended…(6)

[5]: If a Muslim is performing Ḥajj, does he or she fast The Day of ‘Arafah?:

Al-’Allāmah, Ṣāliḥ al-Fawzān, may Allāh preserve him, wrote:

…Prophetic guidance teaches us that it is not recommended for a pilgrim standing at ‘Arafah (i.e. performing Ḥajj) to fast. This is because the Messenger of Allāh, prayers and peace upon him, did not fast while standing at ‘Arafah (7). The reason that he, prayers and peace upon him, did not fast is so that he would have strength to stand and supplicate whilst at ‘Arafah.

So, it is not from the way of the Prophet for a pilgrim to fast on The Day of ‘Arafah. Rather, from his way is not to fast on that day (i.e. if one is a pilgrim performing Ḥajj). (8)

[6]: When is The Day of ‘Arafah?:

As mentioned in the beginning of this article, The Day of ‘Arafah is the ninth day of Thūl ‘Ḥijjah according to the Islamic calendar. That will correspond with Monday, November 15th, 2010, Allāh willing.

May Allah, The Most High, grant all of the pilgrims a successful and accepted Ḥajj, and may He, The Most High, grant those who haven’t been given the opportunity to make Ḥajj the chance to do so in the near future. Indeed, He is the One able to answer our supplications.

Time-unrestricted Takbir from the beginning of Dhul-Hijjah

Q: I hear some people reciting Takbir (saying: “Allahu Akbar [Allah is the Greatest]“) after each Salah (Prayer) during the Days of Tashriq (11th, 12th and 13th of Dhul-Hijjah) until the ‘Asr (Afternoon) Prayer of the third day. Is this correct or not?
A: It is prescribed to recite an unrestricted [in terms of time. Ed] or a restricted Takbir during ‘Eid-ul-Adha (the Festival of the Sacrifice). The unrestricted Takbir can be recited at any time from the beginning of Dhul-Hijjah until the last Day of Tashriq. The restricted Takbir should be recited after the Obligatory Daily Prayers starting from the Fajr (Dawn) Prayer of the Day of ‘Arafah until the ‘Asr Prayer on the last Day of Tashriq. The evidence for the permissibility of doing this is the Ijma‘ (consensus of scholars) and the practice of the Sahabah (Companions of the Prophet, may Allah be pleased with them).

Is it permissible for a woman to slaughter an animal?

The Ruling on a Woman’s Slaughter

Question:
Is it permissible for a woman to slaughter an animal? And is it permissible to eat from it?

Answer:

It is permissible for a woman to slaughter an animal, the same as a man, as has been confirmed by the Sunnah from the Messenger of Allaah sallallaahu ‘alaihi wa sallam. It is permissible to eat from the animal she has slaughtered, if she is a Muslim or one of the People of the Scripture and the animal was slaughtered according to the Islamic Law, even if a man was available to do it for her. It is not a condition for the permissibility of her sacrificial animal that there be no man present.
