بسم ألله الرحمن الرحيم
الحمد لله رب العالمين ، والصلاة والسلام على سيد المرسلين وخاتم النبيين ، نبينا محمد وعلى آله وأصحابه أجمعين أما بعد:
Shaykh Muhammad Bazmool—may Allah preserve him—said:
Martyrdom is a great virtue from Allah, and it has conditions and preventers, thus whoever does not fulfill the conditions, and negate the preventers, then he will be forbidden from this virtue and he will not be a martyr!
From the preventers of martyrdom are [Extracted from the book: Jihad—its conditions, categories and guidelines by Shaykh Muhammad Bazmool]:
1. Going out to fight without the permission of the Muslim ruler.
Allah the Exalted said:
وإِذَإ جَاءَهُمْ أَمْرٌ مِنَ إلَْْمْ نِ أَوِ إلْخَوْفِ أَذَإعُوإ بِهِ وَلَوْ رَدُّوهُ إِلَى إلرَّسُولِ وإِلَى أُولِي إلَْْمْرِ مِنْهُمْ لَعَلِمَهُ إلَّذِينَ يَسْ تَنْبِطُونَهُ مِنْهُمْ وَلَوْلََ
فَضْلُ إللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ لََتَّبَعْتُمُ إلشَّيْطَانَ إِلََّ قَلِيلً
When there comes to them some matter touching (public) safety or fear, they make it known (among the people), if only they had referred it to the Messenger or to those charged with authority among them, the proper investigators would have understood it from them (directly). Had it not been for the Grace and Mercy of Allah upon you, you would have followed Shaytan, save a few of you. [Soorah An Nisa 4:83]
Therefore as it relates to the great affairs which concern the Ummah—from them being Jihad—the final say belongs to the Muslim ruler; it is not for any and everyone (to have a say in the matter). End Quote.
The Prophet صَلَّى اللََُّّ عَلَيْهِ وَسَلَّمَ , said:
إِنَّمَا الِْْمَامُ جُنَّةٌ يُقَاتَلُ مِنْ وَرَائِهِ
Only the Imaam is only a shield who is fought behind.

Ibn Taymiyyah —may Allah have mercy upon him—said: Jihad is only established by the leader of the affairs of the Muslims.[Minhaj As Sunnah (6/118)] Thus the Muslim ruler is the one who calls for Jihad not rogue leaders, or individuals.
2. Fighting those whom it is not permissible to fight.
The Messenger of Allah َمَّلَس َ و ِهْيَلَع ُ َّ اللَّ ىَّل َص, said:
مَنْ قَتَلَ مُعَاهِدًا لَمْ يَرَحْ رَائِحَةَ الْجَنَّةِ ; وَإِنَّ رِيحَهَا تُوجَدُ مِنْ مَسِيرَةِ أَرْبَعِينَ خَرِيفًا
“Whoever kills a person who is under an agreement or treaty (with the Muslims); he will not smell the fragrance of Paradise, even though its fragrance can be found from the distance of 40 years away”.

Allah the Exalted said:
وَإِنِ اسْتَنْصَرُوكُمْ فِي الدِّينِ فَعَلَيْكُمُ النَّصْرُ إِلََّّ عَلَى قَوْمٍ بَيْنَكُمْ وَبَيْنَهُمْ مِيثَاقٌ وَاللََُّّ بِمَا تَعْمَلُونَ بَصِيرٌ
But if they seek your help in religion, it is your duty to help them except against a people with whom you have a treaty of mutual alliance, and Allah is the All-Seer of what you do. [Soorah Al Anfal 8:72]
Imaam Sa’dee—may Allah have mercy upon him—said in his explanation of the statement of the Exalted: ‘except against a people with whom you have a treaty of mutual alliance’. Meaning an agreement to abandon fighting (against the non-Muslims you have a treaty with); then if the believers, those who did not migrate, desire to fight against the non-Muslims, then do not assist them due to the agreement between you and them. End Quote.
3. Fighting beneath the banner of blind partisanship.
وَمَنْ قَاتَلَ تَحْتَ رَايَةٍ عِمِّيَّةٍ يَغْضَبُ لِعَصَبَةٍ أَوْ يَدْعُو إِلَى عَصَبَةٍ أَوْ يَنْصُرُ عَصَبَةً فَقُتِلَ فَقِتْلَةٌ جَاهِلِيَّة
Whoever fights under the banner of blind partisanship, becomes angry for partisanship, or calls to partisanship or supports partisanship, and is killed, then he has died upon Jahiliyyah.

4. Fighting in order to achieve martyrdom!
Shaykh Muhammad Bazmool said:
‘It is not correct for the one who goes out for Jihad to go out with the purpose of seeking martyrdom; rather it is a must that he goes out seeking to elevate the statement of Allah and if he achieves martyrdom this is a virtue from Allah. And if he does not achieve martyrdom he returns with the reward and the spoils of war. Some of the people desire to kill themselves but they know suicide is not permissible. Thus he goes out to what he believes is a Jihad and he wants to be killed. And he thinks by this he will achieve the reward of martyrdom and he will become a martyr! Ponder the previous hadith that will explain to you what I am saying:
The Prophet َمَّلَس َ و ِهْيَلَع ُ َّ اللَّ ىَّل َص, said:
تَضَمَّنَ اللََُّّ لِمَنْ خَرَجَ فِي سَبِيلِهِ لََّ يُخْرِجُهُ إِلََّّ جِهَادًا فِي سَبِيلِي وَإِيمَانًا بِي وَتَصْدِيقًا بِرُسُ لِي فَهُوَ عَلَيَّ ضَامِنٌ أَنْ أُدْخِلَهُ
الْجَنَّةَ أَوْ أَرْجِعَهُ إِلَى مَسْكَنِهِ الَّذِي خَرَجَ مِنْهُ نَائِلًً مَا نَالَ مِنْ أَجْرٍ أَوْ غَنِيمَةٍ
Allah has guaranteed for the one who goes out in His path, and he does not go out except for Jihad in My path, believing in Me, and affirming My Messengers, then it is upon Me a guarantee to enter him into paradise or return he to his residence that he left from, obtaining the reward or the spoils of war.[Collected by Muslim 3484]
If this (Meaning: Going out with the intent to die and become a martyr) was legislated why didn’t the Prophet صَلَّى اللََُّّ عَلَيْهِ وَسَلَّمَ do it? Why didn’t the Companions do it? Why were we commanded to make preparations? Why did the Messenger صَلَّى اللََُّّ عَلَيْهِ وَسَلَّمَ wear armor? Where is the intent of Jihad to elevate the statement of Allah? Reflect; if the Islamic army had this resolve then the soldiers would expose themselves to die and they would not achieve elevating the statement of Allah! Thus it is upon the Muslims to pay attention to this affair, because it is from the subtle affairs of the hearts. And it is from the ways Shaytan can enter and corrupt righteous actions’.
5. Fighting without the permission of the parents.
أَنَّ رَجُلً مِنَ الْيَمَنِ هَاجَرَ إِلَى رَسُولِ اللََِّّ صلى اللَّ عليه وسلم فَقَالَ : ” هَلْ لَكَ أَحَدٌ بِالْيَمَنِ ؟ ” قَالَ : أَبَوَايَ , قَالَ : ” أَذِنَا لَكَ ؟ “
قَالَ : لَّ , قَالَ : ” ارْجِعْ إِلَيْهِمَا فَاسْتَأْذِنْهُمَا فَإِنْ أَذِنَا لَكَ فَجَاهِدْ وَإِلَّ فَبَرَّهُمَا
It was reported from Abu Sa’eed—may Allah be pleased with him:
“A man migrated to the Prophet (peace and blessings of Allah be upon him) from the Yemen. He صَلَّى اللََُّّ عَلَيْهِ وَسَلَّمَ said, ‘Do you have anyone in the Yemen?’ He said, ‘My parents.’ He said, ‘Did they give you permission?’ He said, ‘No.’ He said, ‘Then go back to them and ask their permission. If they give you permission, then go for Jihad, otherwise honor them [Collected by Ahmad (3/75-76)]
Therefore reflect my dear brothers and sisters in Islam, O Muslim youth—those of you who are being encouraged to participate in a so-called “Jihad”; consider the following:
Allah the Exalted said:
فَمَنْ كَانَ يَرْجُو لِقَاءَ رَبِّهِ فَلْيَعْمَلْ عَمَلًً صَالِحًا وَلََّ يُشْرِكْ بِعِبَادَةِ رَبِّهِ أَحَدًا
So whoever hopes for the Meeting with his Lord, let him work righteousness and associate none as a partner in the worship of his Lord.[Soorah Al Kahf 18:110]
Imaam Ibn Kathir—may Allah have mercy upon him—said:
“Let him work righteousness” means the action must be in accordance with the legislation of Allah. “And associate none as a partner in the worship of his Lord”. This is the action which is performed seeking the Face of Allah only, without partners. These are the two pillars required for the actions to be accepted. It must be done sincerity for the sake of Allah, and it must be in accordance with the legislation of the Messenger of Allah صلى اللَّ عليه وسلم . End Quote.
Actions in Islam have pillars, conditions, and nullifiers. One cannot hope to reap the rewards of his actions if he does not fulfill the conditions or if he falls into nullifiers which negate the action. So how about the person who embarks upon an action without knowing its conditions or nullifiers?!
An example of this is Hajj, the pilgrimage to the sacred house in Mecca. Every Muslim knows Hajj is from the greatest acts or worship; rather it is from the pillars of Islam. The Prophet صلى اللَّ عليه وسلم said:
مَنْ حَجَّ هَذَا الْبَيْتَ ، فَلَمْ يَرْفُثْ ، وَلَمْ يَفْسُقْ ، خَرَجَ مِنْ ذُنُوبِهِ كَمَا وَلَدَتْهُ أُمُّه
Whoever performs Hajj and does not commit any obscenity or commit any evil will go back (free of) sin as on the day his mother bore him. Collected by Al-Bukhaari (1521) Declared authentic by Shaykh Al Albani
MashaAllah! What a great reward! But do you anticipate receiving this reward without having knowledge of how the Hajj is performed? What are the months of Hajj? What are the rites of Hajj? What is the attire I should adorn for Hajj? Where and when should I adorn this attire?
O Muslim youth I ask you—Do you know the conditions and guidelines of Jihad?
Or are you going forward while being heedless of its conditions, guidelines and regulations?
Can a Muslim establish the prayer without knowing how to perform wudoo, without knowing what nullifies wudoo? Without knowing the pillars and conditions of the Salat? Without knowing what nullifies the Salat? What time to pray, what direction to face, how many rakats to pray, what to say during the prayer?
Or do you say Allah the Exalted has placed conditions and guidelines for the prayer, fasting, zakat, and Hajj, while ordering Jihad without conditions and guidelines?! Allah is far above and free from such a thing!
Do you believe the Messenger of Allah صَلَّى اللََُّّ عَلَيْهِ وَسَلَّمَ has given us specific guidelines in what animals may be sacrificed for Udhiyah  but has given the Muslim no guidelines in taking human life?!
Do you believe the Messenger of Allah صَلَّى اللََُّّ عَلَيْهِ وَسَ لَّمَ has detailed to us which harmful animals may be killed  and which animals may not be killed, while allowing you to take human life as you see fit?!
Islam gives us details and guidelines for: Entering the bathroom, exiting the bathroom, relieving ourselves while in the bathroom, how to eat, how to sleep, how to be intimate with our spouses, how to yawn, how to sneeze, how to dress, how to undress, weddings, childbirth, burial, sleeping, awakening from sleep, buying, selling and lending, hairstyles and hygiene, sports and entertainment, manners of joking, medicine and surgery etc.
مَا فَرَّطْنَا فِي الْكِتَابِ مِنْ شَيْءٍ
Nothing have We omitted from the Book [Soorah Al-An'am 6:38]
Is every aspect of our lives governed and detailed except Jihad?!
مَا لَكُمْ كَيْفَ تَحْكُمُونَ )
أَمْ لَكُمْ كِتَابٌ فِيهِ تَدْرُسُونَ ) ( إِنَّ لَكُمْ فِيهِ لَمَا تَخَيَّرُونَ )
أَمْ لَكُمْ أَيْمَانٌ عَلَيْنَا بَالِغَةٌ إِلَى يَوْمِ إلْقِيَامَةِ إِنَّ لَكُمْ لَمَا تَحْكُمُونَ )
) سَلْهُمْ أَيُّهُمْ بِذَلِكَ زَعِيمٌ )
What is the matter with you? How judge you?
Or do you have a scripture in which you learn
That indeed for you is whatever you choose?
Or you have oaths from Us, reaching to the Day of Resurrection that yours will be what you judge.
Ask them, which of them will stand surety for that!
[Soorah Al Qalam 68: 36-40]
So fear Allah O Muslim youth! That which the followers of Osama Bin Laden, Anwar Al Awlaki and the likes call you to is neither Jihad nor martyrdom; rather it is terrorism plan and simple.
 The Prophet (peace and blessings of Allah be upon him) was asked, “What should be avoided in the sacrificial animals?” He gestured with his hand and said, “Four: a lame animal which is obviously lame, a one-eyed animal whose defect is obvious, a sick animal whose sickness is obvious, and an emaciated animal that no one would choose. And he said: “Do not sacrifice anything but a musinnah; if one is not available then sacrifice a jadh’ah sheep (one that is over a year old).” Narrated by Muslim (1963). (A musinnah is a camel, cow or sheep that is two years old or older.)
 The Prophet (peace and blessings of Allah be upon him) said: There are four (creatures), all of which are vermin and may be killed inside the sanctuary and outside: kites, crows, rats and vicious dogs. Al-Bukhaari (1829) and Muslim (1198)

Q 5: The Al-Tijaniyyah sect has their own supplication called Salat Al-Fatih, which they consider to be better than reciting the Qur’an. Is this true? Moreover, on Friday before Maghrib (Sunset) Salah and after Subh (Dawn) Salah, they circle around a piece of cloth on which, they claim, the Prophet (peace be upon him) and Ahmad Al-Tijany sit. During such times they recite the supplication called Salat Al-Fatih. Please, provide evidence and clarify if this practice is proper.
A: All their claims are false. Moreover, their deeds are null and void and are considered to be Bid’ahs (rejected innovation in religion).
|For more clarification, I will cite the so-called Salat-ul-Fatih (Remembrance from the Tijaniyyah order).The following is cited in the Simplified Encyclopedia of Contemporary Religions, Doctrines, and Parties – The World Assembly Of Muslim Youths: “Their leader, Ahmad Al-Tijany, claims that he physically met the Prophet, peace be upon him, talked with him, and learned Salat-ul-Fatih from him- The wording of this Salat reads: “O Lord, have peace and blessings upon our master Muhammad, the opener of the closed, the last of the prophets, the supporter of right with right, and the guide to Your straight path, his family as high as his standing and rank.” They have beliefs concerning this Salah, including:The Messenger of Allah, peace be upon him, told him that the reward for reciting it once is equivalent to that of reciting the Qur’an six times.
The Messenger of Allah, peace be upon him, told him once again that the reward for reciting this Salah once is six thousand times as much as that for every Dhikr (Remembrance of Allah), Du`a’ (supplication), long or short, and the recitation of the Qur’an (Jawahir Al-Ma`any Wa Bulugh Al-Amany, vol. 1, p. 136)
The reward for such Salah is gained only if the reciter is authorized to recite it. This means there should be a chain of authorization tracing back to Ahmad Al-Tijany who, according to him, received this Salah from the Messenger of Allah.
Allegedly being the words of Allah (Exalted be He), this Salah is deemed to be a Hadith Qudsy (Revelation from Allah in the Prophet’s words) (Al-Durrah Al-Faridah, vol. 4, p. 128).
- He who recites Salat-ul-Fatih ten times will gain a reward that even an `Arif (Sufi who has reached a high station of worship) who had lived for one million years would not get if he had not recited it.
- He who recites this Salah even once will have his sins forgiven and will have a reward as much as that for six thousand Tasbihs (saying: “Subhan Allah [Glory be to Allah]“), Du`a’s (supplication), and Dhikrs. (See Mushtaha Al-Kharif Al-Jani, pp. 127, 299 and 300.
I say that the following verse applies to the above: “Then woe to those who write the Book with their own hands and then say, ‘This is from Allah,’ to purchase with it a little price!” The Committee elaborated on this sect in the previous Fatwas.

Are the Sufi Grave-Worshippers who Build Places of Worship over Graves The Worst of Creation in the Sight of Allaah?
Saheeh al-Bukhaaree, Chapter: “Building A Mosque Over A Grave”
‘Aaisha (radhi Allaahu ‘anhaa) said:
When the Prophet (salallaahu ‘alaihi wassallam) became ill, some of his wives mentioned a church they had seen in Ethiopia called Maariyah. Both Umm Salamah and Umm Habeebah had been to Ethiopia. They spoke about the beauty of the church and the images inside it. The Messenger (salallaahu ‘alaihi wassallam) raised his head and said:
“When a pious man would die from amongst those people, they would build a place of worship over his grave, then they would make those images in it. They are the worst of creation in the site of Allaah. (No. 1341).
The Sufis are renowned worldwide for building structure, domes, courtyards and mosques over graves. They gather there and carry out acts of worship in and around these structures, just as the Prophet mentioned in the above narration. These are acts of polytheism rejected by Islaam, condemned by Allaah and His Messenger (salallaahu ‘alaihi wassallam).

What is the ruling on Jihâd today? Is it obligatory for some Muslims or for all? When is it obligatory for the entire Ummah if it only is obligatory for some Muslims?
Shaykh Ibn ‘Uthaymîn:
Firstly, you have to know that Jihâd is not obligatory for all Muslims. This is impossible. Allâh (ta’âlâ) said:
“And it is not for the believers to go forth [to battle] all at once. For there should separate from every division of them a group [remaining] to obtain understanding in the religion and warn their people when they return to them that they might be cautious.” (9:122)
If all were to have gone out in Jihâd, the rest of the prescriptions and rituals would have ended. However, it can become Fardh ‘Ayn (obligatory for all Muslims) in the following cases:
1 - On the frontline. If one comes here, one should accomplish the war.
Allâh (ta’âlâ) said:
“O you who have believed, when you meet those who disbelieve advancing [for battle], do not turn to them your backs [in flight]. And whoever turns his back to them on such a day, unless swerving [as a strategy] for war or joining [another] company, has certainly returned with anger [upon him] from Allah , and his refuge is Hell – and wretched is the destination.” (8:15-16)
2 - When the enemy attacks one’s country. Here it becomes obligatory to fight to defend oneself and one’s Islamic country.
3 - When the LEADER orders him to go out in Jihâd. Write the word “LEADER” with capital letters. It means that one has to have a leader who leads the Islamic army. When the LEADER orders him to go out in Jihâd, he has to go out. When he orders a country’s population to go out in Jihâd, they have to do it. For it is forbidden to be disobedient towards the rulers. When they are told to do it, they become obliged to fulfill it.
4 - When there is a need of the person. An example of that is that a person is a loner in knowing how a specific weapon is to be managed. In this case, it becomes obligatory for him to fight.
As for what is beyond these four situations, it is not obligatory for all Muslims to fight. Thereto, JIHÂD MUST BE UNDER THE LEAD OF A LEADER. OTHERWISE, A GUERRILLA WAR WOULD HAPPEN. THERE HAS TO BE A LEADER WHO IS LEADING THE ISLAMIC UMMAH. YOU THEREFORE SEE THAT IT DOES NOT GO WELL FOR THOSE WHO GO OUT IN JIHÂD WITHOUT THE LEADERSHIP OF A LEADER. There is a risk that they even attack each other. If they were to triumph, they begin to fight each other.
I ask Allâh that He helps us strive against ourselves. We have to strive against ourselves at the moment. Hearts are sick. The limbs are deficient. Hearts fight against each other. It is firstly this that is in need of Jihâd.
The Khawaarij are the Dogs of the Hellfire

The second question: What is the meaning of the statement of the Prophet ﷺ that the Khawaarij are the dogs of the Fire?
Dogs of the Fire; it has been said that they are the dogs of the Fire because they will be in Jahannam in the images of dogs. Or (it is also said) that they, within the Hellfire, will be transformed into dogs due to the severity of the punishment.
May Allaah reward you, O Shaykh.
