Official Decision and Announcement of the High Judiciary Council of Saudi Arabia…

Just a short time ago, Fatwa-Online was informed of the official decision and announcement of the High Judiciary Council of Saudi Arabia that since the moon of Shawwaal was sighted this evening, here in Saudi Arabia, we have completed twenty nine (29) days of Ramadhaan (1432 A.H.), in accordance with the hadeeth of the Messenger of Allaah (sal-Allaahu `alayhe wa sallam):

((Fast when you see the crescent. If it is obscured to you, then complete thirty days ofSha’baan. And break your fast when you see the crescent. If it is obscured to you then fast thirty days)), [transmitted by al-Bukhaaree and Muslim].

Subsequently, we shall be celebrating ‘Eed al-Fitr on Tuesday 30th August 2011, inshaa.-Allaah

Allaahu Akbar, Allaahu Akbar, Laa ilaahaa ilallaah
Allaahu Akbar, Allaahu Akbar, wa lillaahil-hamd

Allaah is Great, Allaah is Great, there is none worthy of worship except He.
Allaah is Great, Allaah is Great, and to Him belongs all Praise.

Allahu Akbar Kabeera, wal-hamdulillaahi katheera, wa Subhaanallaahi bukratan wa aseela .

(Allaah is the Greatest, and an abundance of praise is due to Him, and glory and praise be to him morning and evening) .

The Siwaak is pleasing to the Lord

The Siwaak which is sometimes called the ‘Miswak’ is a cleaning tool taken from the Arak tree. The Messenger (Sallalaahu Alaihi wa Sallam) used to stress its use for numerous benefits, some of which are mentioned below.  The Siwaak is used as a natural medical tool to clean the teeth, remove plaque and bacteria. It also strengthens the gums.

The Messenger (Sallalaahu Alaihi wa Sallam) said, “The siwaak is a purification for the mouth and pleasing to the Lord.” [Saheeh Al-Bukhaaree, Saheeh Al-Jaami' (3696) Sheikh Albaani rahimahullaah said it is saheeh].

The Messenger (Sallalaahu Alaihi wa Sallam) said, “If it wasn’t to cause difficulty to my nation I would have ordered them to use the Siwaak for every ablution.” [Saheeh Al-Jaami' (5319)  Sheikh Albaani rahimahullaah said it is saheeh].

The Messenger (Sallalaahu Alaihi wa Sallam) said that the Siwaak is from the fitrah (natural state) [Saheeh Al-Jaami' (4009) Sheikh Albaani rahimahullaah said it is hasan].

The Messenger (Sallalaahu Alaihi wa Sallam) never used to sleep except that the Siwaak was by his head and when he  (Sallalaahu Alaihi wa Sallam) woke up he began with the Siwaak. [See Saheehah (2111) and Saheeh Al-Jaami' (4872) Sheikh Albaani rahimahullaah said it is hasan].

Hudayfah ibnul Yamaan t said, “The Messenger (Sallalaahu Alaihi wa Sallam) used to purify his mouth with the Siwaak when waking up for Tahajjud (night prayer).” [Saheeh Al-Bukhaaree and Saheeh Muslim].

Aishah (may Allah be pleased with her) said, “When the Messenger (Sallalaahu Alaihi wa Sallam) would enter the house he would begin with the Siwaak.” [Saheeh Muslim].

The Messenger (Sallalaahu Alaihi wa Sallam) said, “Purify your mouth with the siwaak because it is the path where the Qur’an emanates from.” [Saheeh ibn Maajah].

Narrated Aishah (may Allah be pleased with her) said that from the favours of Allah that He bestowed upon me was that the Messenger (Sallalaahu Alaihi wa Sallam) died in my house on the day of my turn while he was leaning on my chest. Allah made my saliva mix with his at his death.  When Abdulrahman  (my brother) entered upon me with a Siwaak in his hand and I was supporting (the back of) Allah’s Messenger (Sallalaahu Alaihi wa Sallam) on my chest. I saw the Messenger (Sallalaahu Alaihi wa Sallam) looking at it(i.e the Siwaak) and I knew He (Sallalaahu Alaihi wa Sallam) loved the Siwaak, so I said to him, “Shall I take it for you?” He (Sallalaahu Alaihi wa Sallam) nodded in agreement. So I took it and it was too stiff for him to use, so I said to him, “shall I soften it for you?” He (Sallalaahu Alaihi wa Sallam) nodded showing his approval. So I softened it and cleaned his teeth with it. [Saheeh al-Bukhaaree (4449)].

Sheikh Saalih Al-Fawzan says regarding the hadeeth, “If It wasn’t for causing difficulty to my nation, I would have ordered them with the Siwaak” He said:

This hadeeth shows that the Messenger (Sallalaahu Alaihi wa Sallam) was merciful to his nation. He (Sallalaahu Alaihi wa Sallam) didn’t want any difficulty for them. Rather, He (Sallalaahu Alaihi wa Sallam) wanted ease for them and He (Sallalaahu Alaihi wa Sallam) would do actions (of worship) and not order others with them for fear that it would be difficult for them but sufficed with just encouraging them with it.

Siwaak is to use the tooth stick in the mouth to remove the smell and what may be left of food because the mouth could have bad breath due to the food getting stuck in the mouth. Also, it is used to remove smells emanating from the stomach rising to the mouth. Islam is a religion of cleanliness.

The explainer of “Subul sallam” said number of hadeeth on the Siwaak has reached about 100.

Using the Siwaak is from the traits of the Messenger (Sallalaahu Alaihi wa Sallam) and it is from the fitrah (natural state) of a person. It is a stressed Sunnah and it is used in all times but especially for five occasions:

1.  While doing wudu (ablution).
2.  While beginning to pray.
3.  When waking up from sleep
4.  The Messenger (Sallalaahu Alaihi wa Sallam) would use the Siwaak when reading the Qur’an due to it being the speech of Allah and due to the presence of the angels.
5.  When the person senses the change of smell in their mouth.

It is preferable to use the Siwaak all the time even for the fasting person and for the one who is not fasting.

The best type of Siwaak comes from the Arak tree because it is soft and has a good smell.

It is preferable to use the Siwaak to remove bad smells when going to the mosque. This is why the Messenger (Sallalaahu Alaihi wa Sallam) ordered that a person should not eat garlic while going to the mosque.

Question:

I want from the Noble Sheikh an answer to this question. The Messenger of Allah ‎‎‎ ‎‎‎‎ ‎‎‎‎ ‎‎‎‎ said, as has been narrated by the two Sheikhs, ‎Verily you shall see your Lord with your eyes as you are able to see this moon, you will have no difficulty in seeing Him; therefore if you have the ability to be diligent in the prayer before the sun rises and before it sets then do so.
The question is, why does this Hadith make a connection between seeing Allah ‎‎ ‎‎‎ with the Asr and Fajr prayers? Is guarding the prayer at these two times a reason for seeing Allah ‎‎ ‎‎‎?

Sheikh Bin Baz:

Seeing Allah ‎‎‎‎‎‎ in paradise and on the Day of Judgment is the truth, the believers will see Him, and this will be the greatest bliss for the people of paradise. When He removes the veil from His Face and they see Him, they would not have seen anything more beloved to them than looking at His Face ‎‎‎‎‎‎ ‎‎‎‎‎‎.

And the Prophet ‎‎‎ ‎‎‎‎ ‎‎‎‎ ‎‎‎‎ informed us that the believers will see Him on the Day of Judgment with their eyes just as they are able to see the clear sun when there are no clouds and like they are able to see the moon when the moon is full, and they will have no difficulty in seeing Him; this is a confirmed truth with Ahlus Sunnah wa Jamah.

Then the Prophet ‎‎‎ ‎‎‎‎ ‎‎‎‎ ‎‎‎‎ said, ‎Therefore if you have the ability to be diligent in the prayer before the sun rises and before it sets then do so‎,; and what is intended here is the Asr prayer and Fajr prayer.

The people of knowledge mentioned that the secret in this is that the one who guards these two prayers will be from those who see Allah morning and evening. They will see Allah morning and evening in paradise, meaning the time that will be regarded as morning and evening because in paradise there is no night rather it is only continuation day. Therefore what is intended is that which will be regarded as morning and evening, as Allah the Exalted says, ‎And they will have therein their sustenance, morning and evening‎. (Chapter 19 verse 62) Meaning that which is regarded as morning and evening in this world, and like this shall be the viewing of Allah during that time which is regarded as morning and evening.

Meaning the exclusive people of paradise, for them will be the viewing of Allah during the time between morning and evening, meaning they will see Him a lot due to their good actions and their truthfulness in faith. And from the reasons (for this blessing) are their guarding the Asr prayer and the Fajr prayer these two prayers are special. And guarding these two prayers is from the evidences of a person‎s strong faith and completeness in faith, along with guarding the other prayers.

Therefore it is obligatory to guard all the prayers but the Asr prayer and Fajr prayer are particularized with extra care and caution, because this is the opposite of what is done by the hypocrites and those who are lazy.

وَكَانَ الْفُضَيْل بْن عِيَاض يَقُول : يَا كَذَّاب يَا مُفْتَرٍ , اِتَّقِ اللَّهَ وَلَا تَسُبَّ الشَّيْطَان فِي الْعَلَانِيَة وَأَنْتَ صَدِيقُهُ فِي السِّرّ

It is reported that Imâm Muhammad b. Sîrîn – Allâh have mercy on him – said:
There were people who abandoned knowledge and sitting with the scholars, and [instead] took to their chambers and prayed until their skin dried [from exertion in worship]. Thereafter they began to contradict the Sunnah and thus were destroyed. By Allâh, never does a person act without knowledge, except that he spoils and corrupts more than he fixes and rectifies.

Islam is not a religion of equality but of Justice

There are some people who speak of equality instead of justice, and this is a mistake. We should not say equality, because equality implies no differentiation between the two. Because of this unjust call for equality, they ask, “What is the difference between male and female?” So they have made men similar to women. The communists said, “What difference is there between the ruler and the subject? No one has any authority over anyone else.” Not even the father over his son?! So they said the father has no authority over his son and so on.Instead, if we say justice, which means giving each one what he or she is entitled, this misunderstanding no longer applies, and the word used is correct. Allah does not say in the Qur’an that He enjoins equality. He said (interpretation of the meaning):

 “Verily, Allah enjoins Al‘Adl (i.e. justice)” (Qur’an, 16:90)

“And that when you judge between men, you judge with justice.” (Qur’an, 4:58)

 Those who say that Islam is the religion of equality are lying against Islam.Rather Islam is the religion of justice, which means treating equally those who are equal and differentiating between those who are different. No one who knows the religion of Islam would say that it is the religion of equality. Rather what shows you that this principle is false is the fact that most of what is mentioned in the Qur’an denies equality, as in the following verses: “Say: Are those who know equal to those who know not?” (Qur’an, 39:9)

 “Say: Is the blind equal to the one who sees? Or darkness equal to light?” (Qur’an, 13:16)

 “Not equal among you are those who spent and fought before the conquering (of Makkah, with those among you who did so later.” (Qur’an, 57:10)

“Not equal are those of the believers who sit (at home), except those who are disabled (by injury or are blind or lame), and those who strive hard and fight in the Cause of Allah with their wealth and their lives.” (Qur’an, 4:95)

Not one single letter in the Qur’an enjoins equality, rather it enjoins justice. You will also find that the word justice is acceptable to people, for I feel that if I am better than this man in terms of knowledge, or wealth, or piety, or in doing good, I would not like for him to be equal to me.Everyone knows that it is unacceptable if we say that the male is equal to the female. – Sheikh Ibn Uthaymeen,  Sharh Al-Aqeedah Al-Wasitah, 1/180-181

I had travelled to Aleppo from Damascus for da’wah and gave a lesson after which the people dispersed. Normally four to five people from our brothers, our friends, stay behind. [This time] another person stayed behind with them who I had never seen before. He was sitting there, far away from me. His stomach was like this, he was not overweight, slim, yet along with that his stomach was like this [i.e., sticking out].

I said to him, ‘What is this?’

He said, ‘This is ‘Rahmaaniyyah.’’ That was the first time I heard this word, [I heard it] there in Aleppo. I said, ‘What does Rahmaaniyyah mean?’

He said, ‘It means the skewers.’

I said, ‘So why did you come to me?’ I knew why.  He said:

‘To show you our miracles [karaamaat].’

I said to him, ‘This is easy [to deal with].’  That day I had a two-sided blade with me to sharpen my pencil, each side was like this, small.

I said to him, ‘[If that’s the case], I’ll hit you with this blade using my hand.’

So he said, ‘[No], with my hand,’ i.e., he wanted to strike himself with the blade which I would give him.

So I said, ‘No, with my hand.’

He said, ‘With my hand.’ So the people started to look at these words being repeated by both sides, I was saying, ‘With my hand,’ and he was saying, ‘With my hand.’

‘With my hand.’

‘With my hand.’

‘With my hand.’

‘With my hand.’

‘With my hand.’

And I naturally was more patient than him because firstly, I knew I was upon the truth and secondly so many years have passed by me, as many as Allaah has willed, calling all types of people to the true religion of Allaah.

So he became tired and fed up.

[And when he did] the last thing he said was, ‘What’s the difference?’

I was saying to him, ‘With my hand.’ And he was saying to me, ‘With my hand. With my hand.’ Afterwards he got tired and became fed up, and said, ‘What’s the difference?’

I said, ‘If there is no difference, [then] with my hand.’  He then turned the topic on its head, and this is from their ignorance.

He called the person whose house it was, and his name was Abu Ahmad, he said to him, ‘O Abu Ahmad! Bring the brazier [i.e., a metal container for carrying hot coal, etc.].’

I understood what he meant and so I said, ‘O Abu Ahmad, don’t bring the brazier, bring a matchstick.’ Subhaanallaah, he was from the Sufis and they were used to wearing a white head covering without the head cord [iqaal, the round black cord Arabs wear to keep the head covering in place].

So he brought the matchstick. I lit it and got up going towards him and said, ‘You will denounce this false claim of yours or otherwise I will burn you.’

Miskeen, he was speechless, silent, not saying a single word.

I was moving towards him step by step until I came close to him–and I really put the matchstick onto his head covering, and it started to catch fire.

Then I took it and rubbed it against itself like this [i.e., put it out after having proved the falsehood of his claim], fearing that the sparks would increase, I [put it out] like this, and then said to him, ‘Go to those Shaikhs of yours and tell them:

‘These are the miracles [karaamaat] of the Salafis.’

Women are ‘Awrah – Explained

‘Abdullâh b. Mas’ûd – Allâh be pleased with him – said:

Women are but an ‘awrah (something private to be covered). A woman might leave her house without there being any problem with her, but the Shaytân seeks her out and says [to her], “You will not pass by anyone except that you will impress/please him.” A woman puts on her clothes and is asked where she is going, to which she replies, “To visit a sick person,” or “to attend a funeral”, or “to pray in the masjid”; but a woman never worships Allâh in the way she does when she worships Him in her house.

Woe to you! That is the inheritance of Muhammad, salallaahu ‘alayhi wa sallam

Aboo Hurayrah (radiallaahu ‘anhu) once passed by the market in Madinah. He stopped at the market and said: “O people of the market, how incapable you are!” They said, “And how is that Aboo Hurayrah?” He replied, “Over there, the inheritance of Allaah’s Messenger (salallaahu ‘alayhi wa sallam) is being distributed and you are here! Won’t you go and take your share?” “Where is it?” they asked. He replied, “In the Masjid.” So they hurried to the Masjid, and Aboo Hurayrah waited for them until they returned. When they came back, he said, “What’s the matter?” They replied, “Aboo Hurayrah! We went to the Masjid, but we didn’t see anything being distributed.” Aboo Hurayrah asked them, “And you didn’t see anyone in the Masjid?” They replied, “Indeed we did; we saw people praying, others reciting Qur`an and others studying the regulations of halal and haram.”

So Aboo Hurayrah said, “Woe to you! That is the inheritance of Muhammad, salallaahu ‘alayhi wa sallam.”

[Reported by at-Tabaraani in al-Aswaat, with a hassan chain of narrators; Al-Albanee also graded it hasan in Saheeh al-Targheeb wa Tarheeb, Vol 1, pg. 19.]

‘… Who is he that will lend a beautiful loan to Allah.’

That is a successful trade, O Abu Ad-Dahdah!

Ibn Abi Hatim recorded that `Abdullah bin Mas`ud said, “When this Ayah,

[مَّن ذَا الَّذِى يُقْرِضُ اللَّهَ قَرْضًا حَسَنًا فَيُضَاعِفَهُ لَهُ]

(Who is he that will lend Allah handsome loan: then (Allah) will increase it manifold to his credit (in repaying),) was revealed, Abu Ad-Dahdah Al-Ansari said, `O Allah’s Messenger! Does Allah ask us for a loan‘ The Prophet said,

«نَعَمْ، يَاأَبَا الدَّحْدَاح»

(Yes, O Abu Ad-Dahdah.) He said, `Give me your hand, O Allah’s Messenger,’ and the Prophet placed his hand in his hand. Abu Ad-Dahdah said, `Verily, I have given my garden as a loan to my Lord.’ He had a garden that contained six hundred date trees; his wife and children were living in that garden too. Abu Ad-Dahdah went to his wife and called her, `Umm Ad-Dahdah!’ She said, `Here I am.’ He said, `Leave the garden, because I have given it as a loan to my Lord, the Exalted and Most Honored.’ She said, `That is a successful trade, O Abu Ad-Dahdah!’ She then transferred her goods and children. The Messenger of Allah said,

«كَمْ مِنْ عَذْقٍ رَدَاحٍ فِي الْجَنَّةِ لِأَبِي الدَّحْدَاح»

(How plentiful are the sweet date clusters that Abu Ad-Dahdah has in Paradise!)” In another narration, the Prophet said,

«رُبَّ نَخْلَةٍ مُدَلَّاةٍ، عُرُوقُهَا دُرٌّ وَيَاقُوتٌ، لِأَبِي الدَّحْدَاحِ فِي الْجَنَّة»

(How many a date tree that has lowered down its clusters, which are full of pearls and gems in Paradise for Abu Ad-Dahdah!)

Regarding Saying “Mabrook” and the Correct Way to Invoke For Blessings Upon Someone

From Shaykh Ubayd aj-Jaabiree’s Explanation of the Three Fundamental Principles : page 113-114:

“It is allowable to make a supplication for a person that they be blessed.

The correct way to do this is to say: ‘Baaraka Allaahu laka’ or ‘Baarka Allaahu ‘alayka’ and ‘hadhal amr mubaarak’.

The expression that is common upon the tongues of the general people is ‘Mabrook ‘ala fulaan’ (may so and so be knelt upon); this is a blatant mistake and in opposition to the correct usage of the word in the Arabic language.

Mabrook comes from the verb Baraka and Mubaarak comes from the verb Baaraka, so don’t use the word Mabrook; alternatively, use Mubaarak because it comes from Baaraka as we stated. The common people don’t intend by their saying: ‘Mabrook alayhi’ to supplicate that this person be knelt upon, but this expression is incorrect, as they want to make a supplication for the person that they be blessed. So it is said ‘Baaraka Allaahu alayka’… and ‘Az-Zawaaj Mubaarak’ (Allaah willing, the marriage will be blessed).”
