Ruling on invalidation of Wudu upon touching the private parts


Q: Someone from Al-Sharqiyyah governorate, the Arab Republic of Egypt, asks: If a man touches his private parts or the private parts of one of his children, or if the mother touches the private parts of one of her children, must they renew their Wudu’ (ablution)?

A: Yes, if a man touches the private parts without a barrier; namely, the skin of the hand touches the skin of the private part, penis or anus, his ablution will be nullified. Similarly, if a woman touches her private parts or the private parts of her children, her ablution will be nullified.

The Prophet (peace be upon him) stated: He who touches his penis should perform ablution. He (peace be upon him) also stated: He who touches his private parts without a barrier should perform ablution.

Therefore, if someone touches their private parts without a barrier, their ablution will be nullified. But if they do this over a barrier of clothing, loincloth or pants, there is nothing wrong with this and their Wudu’ remains valid. What invalidates Wudu’ is the bare hand touching the skin of the private parts without a barrier between them.

Abu Hurayrah (radhi-yAllaahu ‘anhu) said: Rasoolullaah (sal-Allaahu ‘alayhe wa sallam) said:

 «If one of you touches his penis and there is no veil between him and it nor any cover, then wudhoo has become obligatory for him.» [al-Haakim (1/138) and others]. (al-Albaanee says: hadeeth Saheeh.)

    Alhamdulilahi waassalaat waassalam alaa Rasoolulahi,

    This answer does not cater for the second aspect of the question, which is if somebody touches the private parts of another person; such as if a mother touches the private parts of her child. It is not clear from the response that this ruling includes them. This, in addition to the fact that some other Scholars, such as Shaykh al-Albaani and Shaykh Ibn al-Uthaymeen among other Scholars,opine that the ablution becomes nullified only if the hand touches the private parts, without a barrier, with passion and some enjoyment; but if the touching is not accompanied with any passion or enjoyment, the ablution is not nullified based on that. They based their position, Allah knows best, on the hadeeth that states that one’s private parts is just a part of us; this in response to a question posed to the Messenger of Allah SallaAllahu alayhi waassallam concerning whether one must re-perform one’s ablution for touching the private parts. So, they offered the above-stated opinion on the principle of reconciliation between apparently contradictory textual proofs, provided that is possible. So they reconciled between this hadeeth and the hadeeth mentioned as the proof by the Shaykh who answered the question. Allah knows best

    There is a difference of opinion on this matter. Just thought I share this …Please refer to the commentary of Sh. Albaani on the following hadeeth (don’t have source for shaykhs words, but he states that ones private parts invalidate the wudu ONLY if touched with lust/desire …wallahu alam):

    Talq bin Ali reported that he went with other men to Allah’s Messenger (s). While they were there, a man who appeared to be a bedouin came and asked, “Oh Prophet of Allah! What do you say in regard to a man who touches his penis (during the prayer) after having performed wudu?” The Prophet (s) replied, “Is it anything but a piece of flesh from his body?” (verified to be authentic by Albaani)
